smartNsales AG ("we", "us", "our") is the data controller for this website. We are registered in Switzerland (Zurich) and subject to both the EU General Data Protection Regulation (GDPR) in respect of EEA visitors and the Swiss Federal Act on Data Protection (nFADP / revised DSG, in force 1 September 2023) in respect of Swiss residents.

3 Cookies we use

We group cookies into three categories. The table below lists each cookie, its provider, purpose, duration and legal basis.

3.1 Strictly Necessary

These cookies are essential to operate the website. The site cannot function properly without them. They do not require your consent.

3.2 Analytics & Performance

These cookies help us understand how visitors interact with our website so we can improve it. We only set them after obtaining your consent.

3.3 Marketing & Advertising

These cookies track your browsing habits to help us deliver relevant advertising on other platforms (e.g. LinkedIn). They are only set after your consent.

4 Legal basis for processing

• Strictly Necessary cookies, processed on the basis of our legitimate interest (Art. 6(1)(f) GDPR / Art. 31(1) nFADP) and technical necessity to provide the service you requested. No consent is required.
• Analytics & Marketing cookies, processed only on the basis of your freely given, informed and specific consent (Art. 6(1)(a) GDPR / Art. 31(2)(a) nFADP). You can withdraw consent at any time (see Section 7).

Certain cookies listed above are set by third-party providers. Those providers process data under their own privacy policies, which we link below:

6 International data transfers

Google LLC and LinkedIn Corporation are headquartered in the United States. Where analytics or marketing cookies are active, personal data (e.g. IP address, device identifiers) may be transferred to the USA.

We rely on the following safeguards for EEA-to-US transfers:

• EU Standard Contractual Clauses (SCCs) adopted pursuant to Commission Implementing Decision (EU) 2021/914, or
• EU–US Data Privacy Framework (DPF) where the recipient is certified (Google and LinkedIn are DPF-certified as of 2024).

For Swiss-to-US transfers, we rely on the Swiss–US Data Privacy Framework (effective since 17 July 2023, Federal Council adequacy determination) or, where required, SCCs in the form approved by the Federal Data Protection and Information Commissioner (FDPIC).

7 Your choices & consent

When you first visit our website, a cookie consent banner will appear. You can:

• Essential only, enables only strictly necessary cookies; analytics and marketing cookies are blocked.

9 Swiss nFADP specifics

Switzerland's revised Federal Act on Data Protection (nFADP, "revDSG") entered into force on 1 September 2023. The nFADP aligns Switzerland's data protection framework with the GDPR. Key points relevant to this website:

• The FDPIC's 2025 guidance confirms that non-essential cookies require prior consent, consistent with the approach taken in this policy.
• In the event of a personal data breach, we will notify the FDPIC "as soon as possible" where the breach is likely to result in a high risk to the rights and freedoms of natural persons.
• Non-compliance with the nFADP consent rules may result in personal criminal fines of up to CHF 250,000.
• Swiss residents have the right to access, rectify, erase, and restrict processing of their personal data, as well as the right to data portability and the right to object, consistent with Art. 25 et seq. nFADP.
